Terms of Service

These Terms, together with the Privacy Policy and the Community Guidelines, are the contract between you and Pinily. You accept them when you create an account. If you do not accept them, do not create one.

• You must be at least 13 years old.
• If you are under 18, you may use the free parts of Pinily on your own, but a parent or guardian has to agree before you buy anything — Pinily+, boost credits, or a ticket. Swiss law (Article 19 of the Civil Code) does not let a minor take on that kind of obligation alone.
• One person, one account. Do not create an account for someone else or pretend to be them.
• You are responsible for what happens under your account. If you lose access to your email, use your recovery codes.

Pinily is a place to make plans and find events. It is not the organiser of anything. When you go to an event, the agreement about that event is between you and whoever is hosting it. Pinily does not check hosts, does not verify that an event will happen, does not vet the venue, and is not present.

That is worth reading twice, because it is the whole shape of the thing. You are meeting people from the internet in the real world. Use ordinary judgement: meet somewhere public first, tell someone where you are going, and leave if it feels wrong.

Pinily may change, add or remove features, and may run features marked as beta that can behave unpredictably. If a change materially reduces something you have paid for, you will be told and offered a fair way out.

Your content stays yours. Pinily claims no ownership of your photos, your events, your messages or anything else you make.

To show it to the people you meant to show it to, Pinily needs permission to store it, copy it between servers, resize it and display it. So you grant Pinily a non-exclusive, worldwide, royalty-free licence to do exactly that, for the purpose of running the service, and no further. The licence lasts as long as the content is on Pinily and ends when you delete it — except for copies that have already reached other people's devices, which are beyond anyone's reach.

Pinily will not use your content in advertising, will not sell it, and will not give it to anyone to train a model.

You promise that what you post is yours to post, and that it does not infringe anyone's copyright, trade mark or personality rights. Rules on what is and is not allowed are in the Community Guidelines, which are part of this agreement.

Because chats are end-to-end encrypted, Pinily cannot read them and therefore cannot moderate them proactively. Moderation happens when somebody reports a message and chooses to reveal it.

The Pinily name, logo, app, website, design and source code belong to Pinily and are protected by Swiss copyright and trade mark law. You get permission to use the app for its intended purpose; you do not get permission to copy it, reverse-engineer it, scrape it, or build a competing service out of it.

The app includes open-source components under their own licences, reproduced in full under Settings → About → Open-source licenses.

Pinily+ is an optional paid subscription, monthly or yearly, in Swiss francs. All prices shown include Swiss VAT and every non-optional charge — that is what the Swiss Price Indication Ordinance requires, and the price you see is the price taken.

• There is a 3-day free trial where it says so. A payment method is collected at the start and charged when the trial ends.
• It renews automatically at the end of each period until you cancel. Cancel at least 24 hours before the period ends to avoid the next charge.
• Cancelling stops the next payment. You keep everything you have paid for until the period runs out.
• You can cancel at any time from Settings → Manage subscription. If you bought through the App Store or Google Play, cancel it there — Apple and Google bill you, not Pinily, and only they can stop it.

What Pinily+ includes may change. If something is removed that was a real reason to subscribe, you will be told before it happens.

Buying a ticket

When you buy a ticket, you are buying it from the host, not from Pinily. Pinily handles the payment and takes a platform fee, which is shown before you pay. The host decides the refund policy for their event and it is displayed on the event before you buy.

If a host cancels an event, everyone who paid is refunded in full. If Pinily suspends a host, their future ticketed events are cancelled and everyone who bought is refunded in full.

Hosting a paid event

To take money you need a Stripe Connect account, and Stripe will ask for identity details it is required by law to collect. Payouts are released after the event, less the platform fee and Stripe's fee. A payout can be held while a payment dispute is open or while a fraud flag is being reviewed.

Boost credits

Boost credits promote an event for a limited time. They are consumable, do not expire while your account is in good standing, and are not exchangeable for money. Pinily+ includes a monthly allowance of them.

Swiss law (Article 3(1)(s) of the Unfair Competition Act) requires the steps to be spelled out. They are: you pick what you want; the price payable is shown; you review it in the payment sheet, where you can change the method or go back and correct anything; you confirm; and you get an immediate confirmation on screen and a record in the app.

Switzerland has no general 14-day cooling-off period for things bought online. The right of revocation in Articles 40a–40f of the Code of Obligations covers doorstep sales and telephone sales, not app or website purchases. This is a real difference from EU law, and it is stated here rather than left for you to discover.

What you do get: cancel a subscription at any time for the next period; a full refund if a host cancels a ticketed event; whatever refund policy the host published for their own event; and a refund where the law or a fault on Pinily's side calls for one. If something went wrong, write to contact@pinily.com — a rule is not a reason to be unreasonable.

Purchases made through the App Store or Google Play follow Apple's and Google's refund rules, and only they can grant those refunds.

Pinily can suspend or close an account that breaks these Terms or the Community Guidelines, or where there is a serious safety or fraud concern. Where it is reasonable, you will be told why and given a chance to answer.

If your account is suspended:

• You are not charged while it lasts. A suspension with an end date pauses a Pinily+ subscription bought through Pinily and pushes your next payment back by the days you lost. A suspension with no end date cancels it and refunds the unused part of the period.
• A subscription bought through the App Store or Google Play cannot be paused or refunded by Pinily. Cancel it in your device's subscription settings. If the suspension is lifted, the lost days are added back.
• Boost credits are held, not spent, and come back if the suspension is lifted.
• Ticketed events you had not yet held are cancelled and every buyer is refunded in full. Money from events that already happened is held while the suspension lasts.
• Where the suspension relates to payment fraud, chargeback abuse, or selling tickets to events that do not take place, the remainder of a subscription is not refunded.

You can close your account yourself at any time from Settings → Account & security. Deletion is blocked while you are hosting a future event other people have joined — finish or cancel those first.

Pinily is liable for damage it causes through unlawful intent or gross negligence. Under Article 100(1) of the Swiss Code of Obligations that liability cannot be excluded in advance, and this agreement does not try to.

Beyond that, and to the extent Swiss law allows, Pinily is not liable for:

• what happens at an event, or what anyone does there — Pinily is not the organiser and is not present;
• what other users do, say, post or fail to do;
• an event that is cancelled, moved, or turns out not to be what it looked like;
• a third-party service being down — a payment provider, a push service, a map or a weather feed;
• data you lost because you did not set up a chat backup, or lost the recovery code to one. Pinily cannot recover an encrypted backup without that code. Nobody can. That is the point of it.

Your statutory rights as a consumer under Swiss law are unaffected by anything in this section.

Pinily is offered as it is, without a guaranteed level of availability. Maintenance happens, and so do outages. Nothing here promises an uninterrupted service.

These Terms can change. You will be told in the app before a material change takes effect, and asked to accept the new version. The version you accepted is recorded against your account, so it is always clear what you agreed to. If you do not accept a change, you can close your account and, where you have paid for something you can no longer use, get the unused part back.

Swiss law governs this agreement, without its conflict-of-law rules.

If you are a consumer, Swiss procedural law lets you bring a claim at the court where you live, and nothing here takes that away. Before going to court, please write to contact@pinily.com — most things are quicker to fix than to litigate. The Swiss cantonal conciliation authority is the ordinary first step for a civil claim.

• If a clause turns out to be invalid, the rest stays in force and the invalid one is read down to what is lawful and closest to what it meant.
• Not enforcing something once does not waive it.
• You may not transfer this agreement. Pinily may transfer it as part of a sale or reorganisation of the business, and will tell you if that happens.
• The English version is the reference text. The French, German and Italian versions are provided so you can read it in your own language; if a translation and the English differ, the English governs.
